November 6, 2007 - Improper denials of H-1b
based on entry with advance parole
There have been numerous recent reports that the
California Service Center (CSC) has been denying
H-1bs or H-4 solely on the fact that the applicant’s
last entry was on an Advance Parole travel document. The
CSC is incorrect in this matter because it is clear
that H-1 and/or H-4 nonimmigrant who entered the
U.S. with an approved Advance Parole may apply for
an extension of H-1 and/or H-4 status. In fact,
the CSC has since confirmed that it is their policy
to approve H-1b/H-4 applications in these instances.
